Product Warranty
All product Warranties are handled through the manufacturers. The manufacturer's prefers you contact them. They have a system to take care of any claim you may have. Modern Pools Inc in most cases can not warranty the products.
Feel free to call Modern Pools Inc for phone numbers or web addresses of manufacturers. We deal only with reputable companies who warrant their products in a courteous and timely manner.
Modern Pools Inc Will Help Handle Warranty Claims. The Responsibility of the Warranty is between the customer and the manufacturer of the product. No warranty is implied by Modern Pools Inc.

All Shipping of larger items is Freight only and curbside only. For items such as pool kits, Swing sets, and spas the receiver is responsible for unloading the merchandise. You will be phoned to set a time for delivery. NOTE Products offering free shipping is to a business address product shiped to a Residential address will add $45.00 to the price after your order is processed.
To avoid the $45.00 charge use a business address if you can
Shipping charges are changing everyday so it is not posible to set them on our site please call for a quote 1-877-873-7946 this is for freight only.
Shipping cost are only estimated and continental USA only, final cost and total charges will be added. You will be notified of actual shipping costs via E-mail.
Inspect all items when received for shortage or damage. Modern Pools Inc is not responsible for these occurrences. Any Shortage or damage To Shipped items should be reported to the carrier at time of delivery. Any shortages and damaged items are the sole responsibility of the carrier. If not reported there can be no claim of shipping damage or shortage.

Returns,
You may return products with-in 30 days for a full refund of the product price if you are not satisfied. Conditions do apply such as. All returns can be made only after RMA# is issued. There will be a 25% restocking fee on all returns. Shipping cost is non-refundable and buyer is responsible for return shipping. No open boxes will be accepted, returns on new, unopened boxes only. Shipping charges will not be refunded and returned products must be shipped paid.
Exclusions...
No returns on above ground pool kits, spas or heaters, electrical products, custom swingsets, or any custom product.
No returns on products shipped from a third party.
All sales are final on these items.
Cancellations on above Ground Pools or Swing sets Are Accepted Only if The product Has not been Shipped. There Is A 10% Fee On Cancellations.
We are not responsible for typographical errors on invoices. You will receive only the products you ordered.

Can I cancel my order?
Yes, you can, as long as the item has not been received by the vendor or shipped. If the order has already been sent to the vendor we will attempt to cancel the order, but cannot guarantee that the cancellation will be possible. If you do receive an order that was canceled, accept delivery of the item and call the Customer Service Center for return instructions. Back to Top

I canceled my order but I haven't received a credit yet. How long do credits take?
We submit all requests for credits within 24 hours of receipt; however, it may take 7-10 business days for you to receive your credit. You should see this on your next credit card statement or the following one, depending on where you are in your billing cycle. Back to Top

Can I return an item that is damaged, or I just don't want?
If, within 30 days, you are not satisfied with your purchase, we will replace the item or provide a credit for the full merchandise amount less any shipping and restocking charges. Some products cannot be returned. Some can only be returned within 15 days of purchase.Damaged products has to be reported to the shipper at the time of delivery open boxes and inspect the product before you sign for it.

Merchandise returned without authorization will be refused, and the carrier will charge you freight in both directions. To avoid a restocking charge, on some products, please return your merchandise in the original box and packing materials, including all accessories and the owner's manual. Do not destroy or discard original packing for 30 days. The value of missing accessories will be deducted from the credit amount of a return.

Personalized items, opened personal care items, domestic or computer software items, pierced earrings and special order merchandise are not returnable. Refurbished merchandise can only be returned if damaged or defective. Certain merchandise may require manufacturer service first before return is allowed. What happens if the item I ordered is not available?
Our vendors ship products before the estimated delivery in the vast majority of cases. On occasion, however, an order may be delayed due to availability or other circumstances. In the unlikely event there is a change or delay in filling your order, we will notify you via phone, postal mail or email. We know that this can be inconvenient, and we will offer you one of the following alternatives as appropriate to your situation:

Offer an ALTERNATE selection of equal or greater value.

Offer a BACKORDER and new estimated delivery. You can wait for the new delivery date, or cancel for a full refund at any time prior to shipment.

CANCEL your order. We constantly update our computer system with new information from our vendors. On rare occasions new circumstances come to our attention after the placement of your order. Therefore, we reserve the right to cancel your order for a full refund at any time. Back to Top

How long will it take to receive my order?
The standard shipping time for orders shipped via UPS ground is 5-10 days, and promotional items should ship in 4-7 days. Large items such as swimming pools, hot tubs, or appliances are shipped via common carrier (trucking company) most ship with-in 24- to 48 hrs and may take up to 1-7 days to arrive. Can I have an order shipped to my P.O. Box?
No. The vast majority of our merchandise is shipped via UPS, and a valid street address is needed to ensure proper delivery. If a P.O. Box is used as a shipping address, an error message will appear when submitting the order. We also cannot deliver to A.P.O., F.P.O. or foreign addresses. Back to Top

Can I ship my order to a different address?
Yes! When you place your order and come to the Check Out screen, just replace your address with the address you want to ship your merchandise to, then continue. Remember to use a street address, not a Post Office Box, for any shipping address. Back to Top

How are shipping charges calculated?
Shipping charges vary according to product type and destination.

Because we do not warehouse all of our items, your order is shipped directly from one of our thousands of authorized vendors across the country. The individual vendors ultimately determine the method of product shipment. Therefore, we are not able to reduce shipping charges for any reason.

Most products are shipped via UPS (because they offer package insurance and excellent tracking software). Larger items are generally shipped via common carrier, and require higher shipping rates. Select products offer an express shipping option. In most cases, this rapid delivery requires an additional fee. Back to Top
